Terms of Service

Welcome to ApplyTOP. These Terms of Service (“Terms”) govern your access to and use of the ApplyTOP website and service (the “Service”), operated by Taimingu OÜ (“Company”, “we”, “us”), a company registered in Estonia with registry code 14297104.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Account Terms

To use the Service, you must:

• Be at least 16 years of age
• Complete the registration process with accurate and complete information
• Be a human. Accounts created by bots or automated methods are not permitted
• Keep your account credentials secure and remain responsible for all activity under your account
• Notify us promptly of any unauthorized use at office@applytop.com

2. Subscription & Billing

ApplyTOP is a paid subscription service billed weekly, monthly, or yearly. By subscribing you authorize us and our payment processor (Stripe) to charge your payment method on a recurring basis until you cancel.

• Subscriptions renew automatically at the end of each billing period
• You can cancel anytime from your account settings. Cancellation takes effect at the end of the current billing period
• Except where required by law, payments are non-refundable
• We may change prices with at least 30 days' notice; continued use after the change constitutes acceptance

3. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable law
• Infringe intellectual property, privacy, or other rights of any person
• Upload or transmit malicious code or misleading content
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service
• Scrape, copy, resell, or commercially exploit any portion of the Service without our written permission
• Use the Service to apply to jobs fraudulently or misrepresent yourself

4. Service Description

ApplyTOP monitors publicly accessible job listings from sources including LinkedIn, Greenhouse, Lever, Workday, and company career pages, then matches them to your CV and preferences. We do not guarantee that any particular job will be surfaced, that a match will lead to interviews, or that any source will remain accessible.

5. Third-Party Platforms

ApplyTOP is not affiliated with, endorsed by, or connected to LinkedIn Corporation or any other third-party job board, applicant-tracking system, or career site. All brand names and trademarks are the property of their respective owners. Your use of any third-party site is governed by that site's own terms.

6. Service Modifications

We may modify, suspend, or discontinue the Service (or any feature of it) at any time, with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuance.

7. Intellectual Property

The Service and its original content, features, and functionality are and remain the exclusive property of Taimingu OÜ and its licensors. The Service is protected by copyright, trademark, and other applicable laws.

8. User Content

When you upload your CV or submit content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, process, store, and transmit that content solely to operate, improve, and provide the Service to you. You retain all ownership of your content and are solely responsible for it.

9. Termination

We may suspend or terminate your account at any time, without notice, if you breach these Terms or engage in conduct we reasonably consider harmful to us, other users, or third parties. You may terminate your account at any time from your account settings or by contacting office@applytop.com.

10. Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TAIMINGU OÜ NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Changes to Terms

We may modify these Terms at any time. If a change is material, we will provide at least 30 days' notice before the new terms take effect. By continuing to use the Service after changes take effect, you agree to be bound by the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict-of-law provisions. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Estonia, unless applicable consumer-protection law requires otherwise.
